Terms of Service

1. Agreement to Terms
By accessing or using Fleet Command's services, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all renters, dealers, and visitors of the Fleet Command platform.
2. Eligibility
To rent a vehicle through Fleet Command, you must:
- Be at least 21 years of age
- Hold a valid U.S. driver's license
- Maintain active auto insurance meeting North Carolina minimum requirements
- Pass our verification process, including document review
- Have an active rideshare or gig platform account
- Provide a valid payment method
3. Rental Terms
3.1 Weekly Rental Model
All rentals are week-to-week with no fixed end date. Rentals continue until you or Fleet Command terminates the agreement. Weekly payments are charged automatically every 7 days to your saved payment method.
3.2 Pricing Tiers
Fleet Command offers three pricing tiers. Your tier is locked at booking time:
- Starter ($350/week): 1,000 miles/week included. $0.35/mile overage.
- Standard ($375/week): 1,250 miles/week included. $0.30/mile overage.
- Pro ($400/week): Unlimited miles. Fair-use policy applies.
3.3 First Week Payment
The first week's rental is due at booking. Your rental reservation is not confirmed until the first week's payment is successfully processed.
3.4 Mileage Overage
For Starter and Standard tiers, mileage overage is calculated at vehicle return based on odometer readings. Overage charges are billed to your saved payment method automatically. Pro tier renters are subject to a fair-use policy (2,500 mi/week soft cap, 3,500 mi/week hard cap).
4. Payment & Billing
- Payments are processed through Stripe. You authorize recurring weekly charges.
- Failed payments trigger an escalation process: retry → SMS notice → urgent notice → final notice → vehicle recovery.
- Late payments may result in account suspension, late fees, and vehicle recovery.
- All charges are in U.S. dollars.
5. Vehicle Use
You agree to:
- Use the vehicle only for lawful rideshare/gig delivery purposes
- Not remove, disable, or tamper with GPS tracking devices
- Not sublease, share, or allow unauthorized persons to drive the vehicle
- Maintain the vehicle in good condition and report any damage immediately
- Not drive under the influence of drugs or alcohol
- Not use the vehicle outside the state of North Carolina without prior approval
- Return the vehicle in the same condition as received (normal wear excepted)
6. Insurance Requirements
You must maintain active auto insurance at all times during your rental. If your insurance lapses or expires, your rental will be suspended immediately. You are responsible for all insurance-related claims and deductibles.
7. Vehicle Return
You may return your vehicle at any time by scheduling a return through the app or contacting your dealer. Upon return, the vehicle will be inspected and odometer recorded. Any damage beyond normal wear will be charged to your payment method. Cleaning fees ($75) apply if the vehicle is returned in an unclean condition.
8. Termination
Fleet Command may terminate your rental and/or account for:
- Non-payment after escalation process is completed
- Insurance lapse
- Violation of vehicle use terms
- Fraudulent activity
- Tampering with GPS or vehicle equipment
9. Limitation of Liability
Fleet Command provides vehicles on an "as-is" basis. We are not liable for lost income due to vehicle downtime, mechanical issues, or service interruptions. Our total liability is limited to the amount of rental fees paid in the preceding 30 days.
10. Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration in Mecklenburg County, North Carolina, under the rules of the American Arbitration Association.
